Texas lawmakers have recently legalized hemp. Today, hemp and hemp products can be found in stores all over the state. However, licenses are required for both growing and processing hemp in the state. In this article, we will explain all the precise requirements necessary to grow hemp in Texas.

Getting Licensed to Grow Hemp in Texas

The 2018 Farm Bill legalized commercial hemp production and requested submission of state plans by states,  regarding the administration of hemp programs. On June 2019, House Bill 1325 was signed into law by the Governor of Texas and the United States Department of Agriculture (USDA) released its interim final rules on hemp program in Texas on October 2019 . The bill authorizes the production, retail sale, manufacture, and inspection of industrial hemp products and crops in the state. This also includes other hemp products which contain CBD, plus other edible parts of hemp crops.

Anyone wishing to grow hemp in the state of Texas must obtain a license from the Texas Department of Agriculture (TDA). All applications must be submitted online through the TDA eApply portal. Applicants who are facing difficulties are encouraged to contact their TDA regional office.

During the first license application, individuals must register at least one “facility” where hemp will be handled or produced. A “lot permit” allows a license holder to grow one hemp crop of a single, approved variety on one location in Texas. There are separate fees for a lot permit, facility registration and license. Per the state law, the cost for registering a facility is $100 for each registered facility. The lot permits fees are $100 per lot, and the license is also $100.

There may be more than one facility per license, and a license holder can plant more than one lot of hemp per facility. Each facility must have a separate registration, and for every hemp lot planted within a facility, there must be an independent lot permit. After harvesting, a new license is required for planting a new lot of hemp.

A “facility” is an area under the legal control of the applicant, that’s uninterrupted by someone else’s property or public roads. There can be multiple facilities per license.

A “lot” is a contiguous area within a facility comprising the same hemp variety throughout the region. Any area within a facility where hemp will be grown that’s separated by a navigable waterway, a public right of way, or an area bigger than sixty feet will be considered as a different lot and must have a separate lot permit.

For example, if a hemp grower has a license and one facility registered under that license, then decides to plant hemp in two varying locations within the facility simultaneously, he/she needs to acquire two lot permits. After harvesting, if the producer now decides to plant another three lots of hemp in the same facility, they should obtain another three lot permits.
